Residential Pest Control Service Agreement

 

This Service Agreement ("Agreement") is entered into between Gone Pest Solutions, located at 11 High Court Drive, Wilsonton Heights, QLD, Australia ("Service Provider", "We", or "Us"), and the Customer ("You"), as identified in the online booking form submitted via ServiceM8 or other platforms.

1. Scope of Services

We provide pest control services for residential properties in Toowoomba and Brisbane, as specified in the selected service plan (e.g., Basic Pest Plan, termite inspections, or other residential treatments). Services may include:

  • Inspections to identify pest activity and conducive conditions.

  • Treatments using approved pesticides to control specified pests (e.g., ants, cockroaches, spiders, silverfish, or others as per plan).

  • Preventative advice to minimize future pest issues.

  • Follow-up treatments or guarantees as outlined in the chosen plan.

Specific services, frequency, and inclusions are detailed in the plan selected at booking. This Agreement applies to all residential pest control services unless otherwise specified.

2. Term and Renewal

  • The Agreement begins on the date of your initial payment or booking confirmation ("Effective Date") and continues for the duration specified in your selected plan (e.g., 12 months for annual plans).

  • Plans may auto-renew unless canceled in accordance with Section 6.

  • Services will be scheduled based on mutual availability, typically within 7-14 days of the Effective Date.

3. Payment Terms

  • Fees: As quoted in the booking form or plan description, payable via secure methods (e.g., credit card, direct debit) through our online system.

  • Billing: Payments are due in advance, either one-time, monthly, or annually, as per the plan. All fees exclude GST, which will be added at the prevailing rate.

  • Additional Charges: Fees may apply for missed appointments (if not canceled 24 hours in advance), services outside the plan’s scope, or travel surcharges (if applicable). Guarantee-related re-treatments are free unless exclusions apply.

  • Late Payments: Overdue accounts may incur a $25 late fee, and services may be suspended until payment is received.

  • Authorization: By submitting payment, You authorize recurring charges for subscription-based plans.

4. Customer Responsibilities

  • Provide safe, unobstructed access to the property during scheduled visits.

  • Prepare the property as instructed (e.g., secure pets, remove food, ensure ventilation).

  • Disclose allergies, health concerns, pets, children, or other relevant conditions in the booking form to ensure safe service delivery.

  • Notify Us promptly of pest issues or changes in property conditions.

  • Follow post-treatment instructions, including re-entry times (typically 2-4 hours) and preventative measures.

Failure to comply may void guarantees or result in additional fees.

5. Guarantees and Limitations

  • Service Guarantee: For plans with a pest-free guarantee, We will provide free re-treatments for covered pests within the guarantee period, provided You comply with preventative advice and no new conducive conditions exist (e.g., poor sanitation).

  • Exclusions: Guarantees do not cover:

    • Pests not specified in the plan.

    • Issues arising from customer negligence (e.g., unsealed entry points).

    • Pre-existing damage or consequential losses.

    • Force majeure events (e.g., floods, fires).

  • Liability: Our liability is limited to the value of the service fees paid. We are not liable for indirect, consequential, or incidental damages.

  • Warranties: Services are performed in compliance with Australian Pesticides and Veterinary Medicines Authority (APVMA) regulations. No other warranties, express or implied, are provided.

6. Termination and Cancellation

  • By You: You may cancel within 14 days of the Effective Date for a full refund, less fees for services already performed. After 14 days, cancellation requires 30 days’ written notice (via email or ServiceM8), and You may be charged for the remaining term or a pro-rated amount.

  • By Us: We may terminate for non-payment, breach of terms, or if services become unsafe or impractical (e.g., hazardous property conditions).

  • Refunds: Pro-rated refunds for unused services may be issued, less administrative fees, at our discretion.

7. Safety and Compliance

  • We use licensed technicians and APVMA-approved products to ensure safety and compliance with Australian regulations.

  • You acknowledge potential risks of pesticide use and agree to follow safety instructions.

  • You agree to indemnify Us against claims arising from undisclosed conditions (e.g., allergies, structural issues).

8. General Provisions

  • Governing Law: This Agreement is governed by the laws of Queensland, Australia. Disputes will be resolved in Queensland courts.

  • Privacy: Personal information is collected, stored, and used in accordance with our Privacy Policy and Australian Privacy Principles.

  • Amendments: Changes to this Agreement must be in writing and agreed by both parties.

  • Severability: If any provision is invalid, the remaining provisions remain enforceable.

  • Entire Agreement: This Agreement, along with the selected plan details, constitutes the full agreement and supersedes prior communications.

9. Acceptance

By submitting the online booking form and/or making payment, You acknowledge that You have read, understood, and agree to be bound by this Agreement. Electronic submission serves as Your signature.
